207 IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
RSA-3184-1998 (O&M) Date of decision : 21.03.2025 Devinder Singh (Deceased) through LRs ...Appellant Vs. Sampuran Singh (Deceased) through LRs ...Respondent
CORAM:- HON'BLE MR. JUSTICE ANIL KSHETARPAL Present: Mr. Hardip Singh, Advocate for the appellant. *** ANIL KSHETARPAL
, J.
(Oral)
1. Admittedly, the suit filed by the plaintiff has been dismissed by both the Courts below. The appellant before this Court was defendant No.18. He claims to be aggrieved of certain observations made by the Court. Once the suit of the plaintiff has been dismissed, no appeal by defendant No.18 is maintainable because there is no decree against him. Moreover, the observation made by the Court while deciding the suit in favour of the appellant will not operate as res judicata.
2. Hence, the appeal is disposed of.
3. All the pending miscellaneous applications, if any, are also
disposed of.
