Ambedkar Konaseema District, registered for the offences punishable under Sections 326(f), 118(1), 351(2) read with 3(5) BNS, 3(1)(r), 3(1)(s), 3(2)(va) Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015 (SC/ST Act). 2. Heard learned counsel for the petitioners and the learned Assistant Public Prosecutor for the State. 3. Perused the record. On 02.01.2025 Crime No.01/2025 of Draksharama Police Station, Dr. B.R. Ambedkar Konaseema District was registered for the offences punishable under Sections 326(f), 118(1), 351(2) read with 3(5) BNS, 3(1)(r), 3(1)(s), 3(2)(va) Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015 (SC/ST Act). The petitioners alleged to have committed the offences prior to 01.02.2025. Having heard both sides, it is seen that the offences are punishable with imprisonment of seven years and less than seven years. It is, in these circumstances, investigating Police are directed to comply with Section 35(3) of BNSS scrupulously and all the directions given by the Hon’ble Supreme Court in the judgment in Arnesh Kumar vs. State of Bihar and other related rulings. 4. With these observations, the Criminal Petition is disposed of.
