Heard the parties.
The petitioner has been made accused in connection with Telaiya P.S. Case No. 115 of 2025, for the offences registered under Sections 115(2), 117(2), 118(1), 109(1), 126(2), 127(2), 352, 351(2), 324(5), 303(2), 308(2) /3(5) of the B.N.S., 2023, pending in the court of learned A.C.J.M., Koderma. On 10.04.2025 at about 10:40 A.M., free fight ensued between the informant party and the accused persons including the petitioner over the land dispute. Attention has been drawn towards the order of the court of learned S.D.M., Koderma passed in case No. 68 of 2023 in the proceeding under Section 144 Cr.P.C. wherein the learned Magistrate has observed that there is genuine land dispute between the parties with regard to right, title and interest of the land. It was submitted that there is allegation that the petitioner has assaulted one of the injured who had sustained grievous injury, because the informant party was trying to dispossess the petitioner from the land. Mr. Sunil Kumar Dubey, learned A.P.P. has submitted that petitioner is alleged to have caused grievous injury to one of the injured persons. Considering the nature of allegation, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned A.C.J.M., Koderma, in connection with Telaiya P.S.
