Heard learned counsel for the parties and perused the record. 2. This writ petition has been filed seeking following relief :- "Issue a writ, order or direction in the nature of mandamus commanding the respondents (Sub-Divisional Magistrate, Puranpur Pilibhit) to decide the Appeal No. 7648/2024 (Mohd. Nijamuddin Vs. Chetna Jauhari and others) pending since 31.08.2024 within time bound fixed by the Hon'ble Court. ii. Issue a writ, order or direction in the nature of mandamus directing the respondent District Administration to restrained the private respondents from cutting of standing and ripen wheat crops and hot to interfere in peaceful possession over Arazi Nos. 182 and 183 area 0.898 hectare i.e. to the extent of share of Vibhav Mohan Jauhari as being possessed pursuance of transfer deed dated 02.11.2028." 3. Learned counsel for the petitioner submitted that the above-mentioned appeal is pending consideration and the same has not been decided till date. Learned counsel prayed that the same may be decided, expeditiously. 4. Since the above-mentioned appeal is pending, no useful purpose would be served in keeping this petition pending. 5. In view of the above, this writ petition stands disposed of with a direction to respondent No.2 to decide the above-mentioned appeal, in accordance with law, expeditiously, preferably within four months from the date of production of a certified copy of this order, after ensuring service of notice upon all the respondents and providing opportunity of hearing to all the concerned parties provided there is no other legal impediment.
