The petitioners in both the writ petitions are claiming the relief of appointing the petitioners under category V in the respondent/bank. 2. The petitioners were all working as paid Secretaries in the Primary Agricultural Cooperative Society. During the pendency of the writ petition, petitioner No.4 and 5 in WP.No.9539 of 2014 have filed an affidavit seeking permission to withdraw the writ petition. The petitioners 4 and 5 submit that they have been subsequently appointed as Staff Assistants in the Selection Process conducted in the year 2018 and that they are discharging their duty at 3rd respondent/bank at RK Nagar Branch, Kadapa and Porumamilla Branch. Recording their submission, the writ petition was dismissed as withdrawn in so far as petitioner Nos.4 and 5 in WP.No.7539 of
2014. 3. The petitioners claim that they are entitle for absorption for service of the cooperative banks after the Paid Secretaries were decaderised. The petitioners claim that several similarly placed decaderised Paid Secretaries were absorbed into the service of the respondent/banks. 4. It is submitted that the respondent/bank has not considered their cases for absorption though there is a direction from this Court on 18.03.2014 to consider the cases of the petitioners without reference
WP.Nos.7539 and 14077 of 2014 to the services of the common cadre as Paid Secretaries if the petitioners are otherwise eligible.
The 3rd respondent in the counter submits that the petitioners in WP.No.7539 of 2014 were initially appointed as Clerks in their respective Primary Agricultural Cooperative Credit Society after the year 1987 only and that they were promoted to the positions of Secretaries at a later point of time. It is submitted that subsequent to the issuance of GOMs.No.338, dated 12.12.2007 all the eligible decaderised Paid Secretaries were absorbed into services of the 3rd respondent/bank. It is also submitted that all the eligible and deserving Paid Secretaries were absorbed into the services in pursuance of the GO issued by the state. 5. Some of the similarly placed employees who were not considered for absorption on account of their ineligibility have participated in the Selection Process and were selected in the said Selection Process. The petitioners 4 and 5 in WP.No.7539 of 2014 participated in the Selection Process and was selected. 6. It is also submitted that some of the petitioners who failed to meet the eligibility criteria were not considered. It is also submitted that the respondents have strictly followed the Government Orders issued with regard to the absorption of the erstwhile Paid Secretaries and were accordingly considered in terms of the interim directions granted by this Court. 7. Heard the learned counsel appearing for the petitioners and the learned Standing Counsel for the 3rd respondent. 8. It is not in dispute that the respondents have absorbed the eligible Paid Secretaries and accommodated them in the 3rd respondent/bank in pursuance of the directions of this Court. It is also not in dispute that those employees who did not meet the eligibility criteria could not be considered. 9. During pendency of the writ petition some of the petitioners have also attained the age of superannuation.
Considering the submission that the 3rd respondent has complied with the criteria setout in GOMs.No.338, dated 12.12.2007 and also considering the participation of some of the petitioners in Selection Process and their subsequent selection for service with the 3rd respondent. The writ petitions are disposed off in terms of the interim orders granted earlier by this Court. No costs.
