1. None appears on behalf of the petitioners even when the case is taken up for hearing in the second round.
2. It appears that an application moved by the petitioners under
Order 14 Rule 5 of CPC was rejected by the learned trial Court. Learned trial Court has assigned sufficient reasons for rejecting the said application. It is also held by the learned trial Court that the issue proposed by the plaintiffs is already covered under Issue Nos.1 & 2, which pertain to whether plaintiffs No.1 & 2 have a right over 1/3rd share of the suit property.
3. Taking into consideration the reasons assigned by the learned trial Court, I do not find any good ground to interfere with the order passed by the Court below.
4. Accordingly, this petition is dismissed. Sd/-
