The petitioners/State has filed this petition seeking the following relief(s):- 10.1 That, this Hon’ble Court may kindly be pleased to set-aside the impugned Award dated 30/11/2011 declared on 28/01/2012 (Annexure P/1) passed by the learned Labour Court, Rajnandgaon in Case No. 178/I.D.Act/Ref./2007 by a writ of certiorari. 10.2 Further hold that the respondent is not entitled for any relief whatsoever. 10.3 Any other relief, including the cost of the this petition, as it appears to be fit and appropriate to this Hon’ble Court. Mr. Arvind Shrivastava, learned counsel appearing for the respondent- workman would submit that pursuant to award passed by the learned Labour Court, the respondent joined the services, but he stopped working with the department since , 2018. 3. Mr. Rajkumar Gupta, learned Additional Advocate General appearing for the State/petitioners would submit that as the respondent- workman is not working with the department, liberty may be reserved in favour of the State to approach this Court at appropriate stage, if the workman approaches the department claiming any benefit based on the impugned award. 4.
