The Court made the following ORDER: I, THE HONOURABLE JUSTICE DR V R K KRUPA SAGAR CRIMINAL PETITION NO: 467 of 2025 Order:- This Criminal Petition under Section 437 and 439 of the Cr.P.C, is filed seeking to enlarge the petitioner herein/Al on bail in Crime No.258 of 2024 of GRP Police Station, Vishakapatnam registered for the offences punishable under sections 8(c) read with 20(b)(ii)(C) of the NDPS, Act. 2. Heard Sri Abdus Saleem, learned counsel for the petitioner and learned Assistant Public Prosecutor for the Respondent-State. 3. Perused the record. 4. ltwas on 06.08.2024, at platform No.8, Vishakhapatnam Railway station, Railway Protection Force arrested Al and recovered 23.5kgs of Ganja from him and he was remanded to judicial custody. During investigation, police also arrested A2 in connection with the Same crime. 5. The present petitioner is A1, who earlier filed CrI.P.No.7767 of 2024 in this court, and this Court by order dated 06.12.2024 declined to grant bail. lt is about one and half month later the petitioner renewed the application and coming up for hearing.._, a•3;,,,., I- I. 6. Learned Assistant Public Prosecutor representing the State, opposed the bail. 7. Regarding the submissions, it is to be seen that Accused No.2 earlier filed Crl.P.No.744'1 of 2024 and this Court, on 07.ll.2024, granted regular bail to him. The petitioner has been in judicial custody for the last five and half months. 8. Considering the length of detention and the near completion of investigation, any continued detention does not seem necessary. Hence, prayer is granted. 7. ln the result, this Criminal Petition is allowed. The petitioner/AI shall be released on executing a personal bond for Rs.30,000/- (Rupees thirty thousand only) with two sureties must be residents of Andhra Pradesh State only for a like sum each to the satisfaction of the VI Additional Judicial Magistrate of First Class Magistrate for Railways Gum VI Additional Civil Judge Court, Visakhapatnam. On release, the petitioner shall appear before the Station House Officer, concerned, once in a week i.e., on every Sunday between 10.OO a.m. and 01.00 p.m., for a period of three (3) months.
