The case of the petitioner is that he has purchased the vehicle from the respondent No.6 after making payment of all the dues yet the respondents transport authority, respondent No.3 is not transferring the vehicle in his name.
Learned counsel for the petitioner has referred to the certificate of registration in form-23 that has been enclosed as Annexure No.1 to the writ petition that shows the name of the respondent No.6 as the owner of the vehicle. On the basis of instructions received learned Standing Counsel has stated that the petitioner has not produced form-30 specified in the Central Motor Vehicles Rules, 1989 before the authority concerned and therefore in absence of that application, it is not possible for the transfer to be effected. Such being the case, we do not find any reason to interfere in the matter.
It is for the petitioner to produce the form-30 properly filled up before the authority to seek transfer. Subject to the above, the writ petition is dismissed.
