THE HONOURABLE SRI JUSTICE NYAPATHY VIJAY WRIT PETITION NO: 21779 OF 2014 ORDER: This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief:
“…..to issue a Writ, Order or direction more particularly one in the nature of Writ of mandamus declaring the Condition No.1 of the Tender conditions filed through e-procurement vide IFB / Tender No.1/2014-15 / F2 to IFB /Tender No.5/2014-15/F2 dt.12.06.2014 issued by the 2nd Respondent as illegal, arbitrary and contrary to the G.O.Ms.No.581 MA, dt 06.11.1996, G.O.Ms.No. 251 MA & UD M2, Department dt 28.05.2002, G.O.Rt.No.269 MA, dt 07.04.1998 and consequentially direct the 2nd Respondent to open petitioner’s commercial bid and quash the work order granted to the Respondent Nos.3 to 5 by setting aside the Condition No.1 of the Tender conditions obtained through e-procurement vide IFB / Tender No.1/2014-15 / F2 to IFB / Tender No.5/2014-15 / F2, dt 12.06.2014 by finalizing the same as per the existing Tender Rules and pass such other orders....”
2. The time stipulated in the tender for engaging workers through outsourcing Agencies for sanitation is for a period of nine months i.e up to 31.03.2015 for Division-1 to Division-5 in Ongole Municipal Corporation, Prakasam District.
3. In view of passage of time and changed circumstances, the cause in this Writ Petition does not survive for an adjudication by this Court.
4. Accordingly, the Writ Petition is dismissed as infructuous. No order as to costs. As a sequel, miscellaneous applications pending, if any, shall stand closed. __________________ NYAPATHY VIJAY, J Date: 20.03.2025 KK
