And 4 Others Counsel for Petitioner :- Adarsh Singh,Amitabh Agarwal,Indra Raj Singh,Sanjeev Kumar,Sudhanshu Pratap Singh Counsel for Respondent :- C.S.C. Hon'ble Ajit Kumar,J.
1. Heard Sri I.R. Singh, learned counsel for the petitioner and learned Additional Chief Standing Counsel for the State.
2. By means of this petition filed under Article 226 of Constitution of India, petitioner has assailed the
order dated 07.07.2022 whereby the services of the petitioner as an Assistant Accountant alongwith one Sunil Kumar, computer operator, both working on contract basis came to be terminated.
3. Learned counsel for the petitioner submits that Sri Sunil Kumar, Computer Operator, has challenged this
order before this Court vide Writ A No.15462 of 2022 which came to be allowed vide judgment and order dated 02.11.2022. The said judgment is reproduced hereunder:
"Heard the counsel for the petitioner and the learned Standing Counsel. The present petition has been filed challenging the order dated 07.07.2022 (Annexure no.5), whereby the services of the petitioner have been terminated by casting the stigma. The submission of the counsel for the petitioner is that the impugned order has been passed without giving an opportunity of hearing. This court on 10.10.2022 had directed the Standing Counsel to obtain instructions. Based upon the instructions, he argues that the petitioner was given the notice, however, he did not
file any reply to the same. The counsel for the petitioner denies that any notice was ever served upon the petitioner. From the perusal of the order impugned, there appears to be no application of mind with regard to the allegations levelled. Considering the fact that the petitioner has admittedly not been heard prior to passing of the order, no useful purpose would be served in keeping the matter pending. Accordingly, the order dated 07.07.2022 is set aside with the liberty to the respondent to pass a fresh order after giving an opportunity of hearing to the petitioner. To avoid any further delay, it is directed that the petitioner shall appear before the District Magistrate, Kanpur Dehat on
14.11.2022. No further notice shall be given to the petitioner. The writ petition stands allowed with the said observations."
4. Sri I.R. Singh, learned counsel for the petitioner submits that a consequential order came to be passed by District Programme Officer on 30.12.2022 reinstating Sunil Kumar directing him to furnish fresh explanation with regard to charges.
5. Learned Standing Counsel could not dispute the above dispute and submitted that this matter could also be disposed of in terms of order passed in writ petition filed by Sunil Kumar.
6. In view of the above this petition also stands
disposed of in terms of the order passed in Writ A No.15462 of 2022 filed by Sunil Kumar as reproduced hereinabove and consequential order in respect of the petitioner dated 07.02.2022 filed as Annexure No.6 to the writ petition also stands quashed.
