The petitioners are apprehending their arrest in connection with Bengabad P.S. Case No. 123 of 2020, registered for the offences under Sections 341, 342, 323, 324, 325, 307 and 34 of the Indian Penal Code, pending in the Court of learned C.J.M., Giridih. 3. Learned counsel appearing for the petitioners submits that false allegations are made against these petitioners. He next submits that the allegation of assault is against all the accused persons and three of the co-accused persons have already been provided the privilege of anticipatory bail in A.B.A. No. 9641 of 2021 by the co-ordinate bench. He then submits that the petitioners are having no criminal antecedents and disclosure to that effect has been made in para-9 of the petition. 4. Learned A.P.P. appearing for the State has opposed the prayer and submits that the allegation of assault is there. 5. Looking into the contents of the FIR, it transpires that there are general and omnibus allegations of assault against the petitioners and three of the co-accused persons have already been provided the [2025:JHHC:35874] -2- privilege of anticipatory bail in A.B.A. No. 9641 of 2021 by the co- ordinate bench and further petitioners are having no criminal antecedents and disclosure to that effect has been made in para-9 of the petition, I am inclined to provide privilege of anticipatory bail to the petitioners. 6. Accordingly, the petitioners, named above, are hereby directed to surrender before the learned court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned C.J.M., Giridih, in connection with Bengabad P.S. Case No. 123 of 2020, subject to the conditions as laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Sanjay Kumar Dwivedi, J.) Dated:-01.12.2025 Amitesh/-
