IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI (Special Original Jurisdiction) PRESENT THE HONOURABLE JUSTICE DR V R K KRUPA SAGAR CIVIL REVISION PETITION NO: 4113/2013 The Court made the following Order:
Learned counsel Smt A.Padma, learned counsel for revision petitioner appearing online is present. Sri Venkata Rama Rao Kota, learned counsel appering on behalf of Respondent No.1/State Bank of India is present.
2. Heard learned counsel on both sides. Perused the record.
3. State Bank of India obtained decree in O.S.No.16 of 1988 and since J.Drs did not oblige the decree direction, the Bank filed E.P.No.80 of 2010. Subsequently, all the immovable property was put to public auction on 05.06.2013 and the highest bidder was Smt Thamisetti Nagamani, W/o Someswara Rao.
4. As per the statements in the papers before this Court, 1/4th of the amount was deposited on the date of the auction and the remaining balance of 3/4th money with other incidental charges were also deposited within time.
5. The present revision is preferred by the auction purchaser. The only grievance raised is that the Execution Court was not
issuing the sale certificate/sale deed. Hence, this revision is filed only for a direction.
6. Considering the nature of the grievance raised and the prayer made, this revision is allowed directing the Execution Court to do what all that is required to be done under law and overdue towards the auction purchaser, which include issuance of certificates and complying with necessary registration formalities, if they are not done already. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions pending if any, shall stands closed.
