The present application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita has been filed to quash the entire proceedings of Case No. 1413 of 2023, (State Vs. Suresh and others) arising out of Case Crime No. 187 of 2023, under Sections 323, 504, 332, 147, 353 of I.P.C., Police Station- Adampur, District- Amroha, as well as cognizance/ summoning order dated 21.09.2023 pending in the Court of Additional Civil Judge (Junior Division)/ Judicial Magistrate, Hasanpur, Amroha. After some arguments, learned counsel for the applicants does not want to press this application and wants liberty to file an appropriate application/ proceedings before the court of competent jurisdiction. Certified copy of the order may be returned to the learned counsel for the applicant after retaining a xerox thereof.
