W.P.A.20647 of 2025
Md. Aminul Haque & Anr. Versus The State of West Bengal & ors.
Mr. Gour Baran Sau. …for the petitioners.
Mr. B.P. Vaisya Mr. Gourav Das. …for the State-respondents.
Affidavit of service filed by the petitioners be kept with the record. Petitioners claim themselves to be bargadars/share croppers who have been thrown out and/or dispossessed. To that effect, information was furnished to the Officer-in-Charge, Mothabari Police Station and the Superintendent of Police, Malda on or about 16.07.2025. Learned advocate appearing for the State has submitted a report. According to the report, the barga right on the aforesaid land has been struck down by the competent authority and the respondent no.7 was found to be in possession of the property. Be that as it may, the police authorities will not involve and interfere in respect of right, title, interest and possession. However, I find that
2 proceedings have been drawn up under Section 126 of the BNSS. In view of the aforesaid, police authorities would continue their surveillance and ensure that no untoward incident results because of the inimical relationship existing between the petitioners and the private respondents. With the aforesaid observations, WPA 20647 of 2025 is disposed of. There will be no order as to costs. Report so submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioners. All parties shall act on the server copy of this
order duly downloaded from the official website of this Court. Urgent photostat certified copies of this
order, if applied for, be given to the parties upon compliance of all requisite formalities.
