I.A. No.16463 of 2025
I.A. No.16463 of 2025 has been filed under Section 5 of Limitation Act on behalf of the appellants for condoning the delay of 525 days in filing this instant Criminal Appeal.

2022 which was disposed of on 07.12.2022 by the Co-ordinate Bench (Hon’ble Justice Rajesh Kumar) of this Court with certain direction. Thereafter, the appellants preferred Cr.M.P. No.27 of 2023 on 03.01.2023, which was dismissed as withdrawn on 21.08.2023 and thereafter the appellants had again preferred Cr.M.P. No.2720 of 2023 which was allowed on 26.08.2023 and
disposed of on 22.01.2024 and thereafter, the instant Criminal Appeal has been filed on behalf of the appellant and hence the delay of 525 days in filing this Criminal Appeal may be condoned. 3. Learned APP has opposed the prayer of the appellants and has submitted that the explanation furnished by the appellants is not satisfactory. 4. It appears from the records that the appellants have been filing repeatedly cases by challenging the order taking cognizance and entire criminal proceeding and it also appear that Cr.M.P. No.27 of 2023 which was withdrawn on 21.08.2023 before the Co-ordinate Bench (Hon’ble Mr. Justice Anil Kumar Choudhary) of this Court. 5. However, the copy of both the orders have not been enclosed in this criminal appeal. 6. After having obtained the web copy of the order of this Court while dictating the order, it further reveals that Cr.M.P. No.27 of 2023 was withdrawn on 21.08.2023 before the Co- ordinate Bench (Hon’ble Mr. Justice Anil Kumar Choudhary) of this Court with liberty to raise all the grounds taken in this Cr.M.P.
7. It further appears that Cr.M.P. No.2703 of 2023 was filed by the appellants by challenging the order dated 25.07.2023 by which the process under Section 82 of Cr.P.C was issued against the appellants and the Cr.M.P. No.2703 of 2023 was allowed on

22.01.2024 by the Co-ordinate Bench (Hon’ble Mr. Justice Anil Kumar Choudhary) of this Court. 8. The appellants have concealed the order of Criminal Appeal (SJ) No.686/2022 which was disposed on 07.12.2022 by the Co-ordinate Bench (Hon’ble Mr. Justice Rajesh Kumar) of this Court. 9. This Court finds that the explanation furnished in I.A. No. 16463 of 2025 by the appellants is not satisfactorily explained. 10. It appears that the appellants had filed this Criminal Appeal No.210 of 2024 for the reliefs prayed for which they could not get in Criminal Appeal No.686 of 2022. 11. It also appears that the appellant had also withdrawn Cr.M.P. No.27 of 2023 on 21.08.2023 before the Co-ordinate Bench (Hon’ble Mr. Justice Anil Kumar Choudhary) of this Court with liberty to raise all the grounds taken in this Cr.M.P. before the appropriate Court at the appropriate stage. 12. Therefore, it is evident that what the appellants could not get it directly now they wanted to get it indirectly by filing this Criminal Appeal (SJ) No.210 of 2024. 13.
Accordingly, I.A. No. 16463 of 2025 is rejected and stands disposed of. 14. Consequently, this Cr. Appeal (SJ) No.210 of 2025 is also dismissed. (Sanjay Prasad, J.) Dated 11.12.2025 Nishant/-
