1. This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.112/2025 registered at Police Station Civil Line, Raipur, District Raipur (C.G.) for the offence punishable under Section 309(4) of B.N.S. and section 25, 27 of Arms Act. Case of the prosecution, in brief, is that the complainant has made complaint to the concerned police station alleging inter-alia that on the date of incident at about 20.15 in the night unknown person have looted the mobile from the complainant with the help of axe at National Highway Road and ran away from the place of incident and police has registered offence against the unknown persons and during investigation, the police has arrested the present applicant on the basis of memorandum statement, which has been registered against the applicant for the offence u/s 309(4) of B.N.S. and section 25, 27 of Arms Act.

Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in this case. She would submit that the police has not seized any article from the possession of the applicant and the applicant has not committed loot of the seized article and only on the basis of memorandum statement, the applicant has been implicated in this case. She would submit that charge sheet has been filed, the applicant is in jail since 07/03/2025 and conclusion of trial will take some time, therefore, she prays for grant of bail to the applicant.
4. On the other hand, learned State Counsel opposes the bail application and he would submit that charge sheet has been filed in this case. He would submit that the applicant has five criminal antecedents which are pending to which explanation has been given by filing an affidavit.
5. I have heard learned counsel for the parties and perused the case diary.

Considering the facts and circumstances of the case, nature of allegation levelled against the applicant and also considering the fact that the applicant has five criminal antecedents which are pending, which shows that the applicant is a habitual offender, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail.
7. Accordingly, the bail application of applicant Keshav Soni involved in Crime No.112/2025 registered at Police Station Civil Line, Raipur, District Raipur (C.G.) for the offence punishable under Section 309(4) of B.N.S. and section 25, 27 of Arms Act, is rejected.
8. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information.
