Perusal of the said Agreement would go on to show that the Commercial Suit bearing COMS No. 05 of 2021, titled as Boehringer Ingelheim International GmbH & another Vs. Dr. Reddy’s Laboratories Ltd. and related proceedings in COPC No. 465 of 2021, titled as Boehringer Ingelheim International GmbH & another Vs. Dr. Reddy’s Laboratories Ltd. & others and COPC No. 337 of 2022, titled as Boehringer Ingelheim International GmbH & another  Vs. G.V. Prasad,  are sought to be withdrawn by the plaintiffs-respondents herein. Similarly, the defendant-appellant herein, has also agreed to withdraw the appeal pending before us. 3. In such circumstances, we are of the considered opinion that the appeal has become infructuous in view of the settlement arrived at between the parties. Accordingly, the same is dismissed as having become infructuous. 3 4. Since the original Settlement Agreement in the suit is not placed in the appeal proceedings, it is open to the parties to place the same on record before the learned Single Judge. The copy of the Settlement Agreement which has been opened by us, is re-sealed. 5. Pending application(s), if any, also stands disposed of. (G.S. Sandhawalia) Chief Justice.
