The present Writ Petition is filed to declare the action of the Respondent No.2 in restraining the Petitioner from constructing the building as per the sanctioned plan vide 52/2013/G1, dated 08.05.2013 at the instance of Respondent Nos.3 and 4, as illegal and arbitrary and to pass such other orders. 2. As per the averments in the Writ Affidavit, the subject matter property was owned by the Petitioner under a registered Partition Deed dated 12.09.2012. The grievance of the Petitioner is that the Respondent No.2 had orally directed the Petitioner not to proceed with the construction though the construction was in the midway. No show cause notice was issued stating any violation or any suppression of the facts by the Petitioner. Despite the same, the construction activities are to be interfered with. Hence, the present Writ Petition is filed. 3. No Counter Affidavit is filed by the Respondents. 4. This Court on 19.12.2013 passed an interim order directing the Respondent No.2 not to interfere with the construction activity of the Petitioner as long as the construction is in accordance with the building plan dated 08.05.2013 issued by the Respondent No.2. 5. As the interim order is in vogue as on date, no further orders are required to be passed in this Writ Petition and the same is disposed of making the interim order absolute. There shall be no order as to costs.
