ORDER 29.04.2025
1. Through the medium of this appeal the appellants have impugned the order dated 23.04.2015 passed by the J&K State Consumer Disputes Redressal Commission at Jammu (hereinafter to be referred as “the State Commission”) in complaint titled, “Dr. Sunny Kumar and other vs. Kazembe Consultancy Pvt. Ltd. and others”, whereby the appellants have been
directed to pay compensation to the respondents.
2. In order to fulfill the statutory requirement to assail the order dated 23.04.2015 passed by the State Commission, the appellants have deposited an amount of Rs. 1.5 lacs before the State Commission and balance amount of Rs. 4.5 lacs with the Registry of this Court, out of which amount of Rs. 03 lacs has already been withdrawn by the respondents pursuant to the order dated 27.02.2017 passed by this Court.

During the course of hearing, learned counsel for both the parties submitted before this Court that the contesting parties have settled the dispute out of court and respondents have agreed to accept Rs. 3.00 lacs, already released in their favour as full and final compensation and further that they have no objection, if the balance amount deposited by the appellants before the State Commission as well as before the Registry of this Court is released in favour of the appellants.
4. In view of the above, we dispose of this appeal as settled. Since Rs. 3.00 lacs out of 4.5 lacs deposited by the appellants stand already released in favour of the respondents, therefore, the balance amount lying with the Registry of this Court be released in favour of the appellants along with interest. Appellants can further approach the State Commission for release of statutory amount deposited by them alongwith interest accrued thereupon in their favour.
