1. Heard learned counsel for the Petitioners,
learned counsel for the State and learned counsel for the Informant.
2. The Petitioners are seeking pre-arrest bail in connection with G.R. Case No.415 of 2025 pending on the file of learned J.M.F.C. (Cog.II), Puri, arising out of Satyabadi P.S. Case No.174 of 2025 for commission of offences punishable under Sections 85/115(2)/117(2)/296/3(5)/351(2) of BNS read with Section 4 of DP Act.
3. It is submitted by the learned counsel for the Petitioners that omnibus allegations have been made and taking into account the nature of allegation, Petitioners may be protected by pre-arrest bail.
4. Such submission is opposed by the learned counsel for the State as well as informant.
5. This Court perused the statement of the complainant as well as that of the younger sister.
6. Taking note of the same, this Court is not inclined to entertain the application for pre-arrest bail in respect of Petitioner No.1 (Santosh Bariki @ Santosh Kumar Bariki).
7. Accordingly, the ABLAPL in respect of Petitioner No.1 (Santosh Bariki @ Santosh Kumar Bariki) stands rejected.
8. So far as the ABLAPL in respect of Petitioner Nos.2 to 6 is concerned, it is directed that on surrendering within three weeks hence and moving for bail, the Petitioner Nos.2 to 6 shall be released on bail by the learned Court in seisin on such terms as deemed just and proper.
9. It is needless to state that the Petitioners shall cooperate with the ongoing investigation.
10. Accordingly, the ABLAPL stands disposed of.
