1. The petitioner has challenged the in-action of the 2nd respondents in not considering his representation dated 17.01.2013, and conducting an enquiry and passing orders of 5th respondent as unreasonable. 2. The petitioner was aged 48 years when the writ petition was filed and now the petitioner has attained the age of superannuation. 3. As seen from the pleadings in the writ petition, there appear to be some family disputes between the family of the petitioner and the 5th respondent. The 5th respondent is the

husband of the petitioner’s sister, who passed away on 01.08.2010 due to multi-organ failure. It is the case of the petitioner that the 5th respondent has secured a false certificate and that the 5th respondent withdrew amounts from the bank account of the petitioner’s sister by using ATM card. 4. The 5th respondent was appointed on compassionate terms from the proposals and recommendations of the 3rd respondent. The petitioner has alleged the appointment of the 5th respondent on the ground that the 5th respondent submitted false Death Certificate and seeks to cancel the appointment of the 5th respondent. 5. The learned Government Pleader draws attention of the Court to paragraph 2 of the counter. The case of the 5th respondent was considered after submission of all relevant records and certificates, such as Death Certificate, Legal Heir Certificate, Nativity Certificate, Caste Certificate, no property certificate, no earning member certificate and educational certificate and that after thorough verification, the 5th respondent was appointed under compassionate terms. 6. Evidently, there appear to be the disputes between the family of petitioner and the 5th respondent, which cannot be adjudicated in a writ jurisdiction. Considering the submissions of the learned Government Pleader, no further orders are required in the present writ petition, accordingly the present writ petition is dismissed without costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
