This is the first bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) for grant of regular bail to the applicant who has been arrested in connection with Crime No.105/2025 registered at Police Station Civil Line, Raipur, District Raipur (C.G.) for the offence punishable under Sections 296, 118(1), GOURI MUDALIAR Digitally signed by GOURI MUDALIAR Date: 2025.09.01 19:49:34 +0530

Case of the prosecution, in brief, is that the complainant has made complaint to the concerned police station alleging inter-alia that on the date of incident i.e. on 02.03.2025 at about 12.00 when the complainant was walking, at that time the accused persons came there and they have quarreled with him and assaulted him by knife and used filthy language. Based upon such complaint, police has registered FIR against accused persons and the applicant for the offence u/s 296, 118(1), 3(5) of B.N.S. and section 25 of Arms Act.

Learned counsel for the applicant submits that the applicant is innocent and he has been falsely implicated in this case. She would submit that the injured received injury by the main accused and not by the present applicant and only on the basis of the memorandum statement, the applicant has been implicated in this case. She would submit that charge sheet has been filed, the applicant is in jail since 08/03/2025 and conclusion of trial will take some time, therefore, she prays for grant of bail to the applicant.
4. On the other hand, learned State Counsel opposes the bail application and he would submit that charge sheet has been filed in this case. He would submit that the applicant has five criminal antecedents which are pending to which explanation has been given by filing an affidavit.
5. I have heard learned counsel for the parties and perused the case diary.
6. Considering the facts and circumstances of the case, nature of allegation levelled against the applicant and also considering the fact that the applicant has five criminal antecedents which are pending,
3 which shows that the applicant is a habitual offender, therefore, this Court is of the opinion that it is not a fit case to enlarge the applicant on regular bail.
7. Accordingly, the bail application of applicant Keshav Soni involved in Crime No.105/2025 registered at Police Station Civil Line, Raipur, District Raipur (C.G.) for the offence punishable under Sections 296, 118(1), 3(5) of B.N.S. and section 25 of Arms Act, is rejected.
8. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information.
