1. By way of the present petition, the petitioner has prayed for the following reliefs:
“10.1 That, this Hon’ble Court may kindly be pleased to set-aside the impugned order dated 01.07.2025 (Annexure P/1) passed by the respondent no. 2. 10.2 That, this Hon’ble Court may kindly be pleased to set-aside the impugned order dated 01.07.2025 and may kindly be pleased to direct to the respondent authority to disburse the award amount to the petitioner.
10.3 That, this Hon’ble Court may kindly be pleased to grant any other relief(S), which is deemed fit and proper in the aforesaid facts and circumstances of the case.”
2. Learned counsel appearing for the petitioner submits that the petitioner is challenging the impugned order dated 01.07.2025 passed by the
3 respondent no. 2 learned Commissioner Division Surguja, District- Surguja (C.G.) in Revenue Appeal Case No. 202404960100034/A- 19/2023-2024 whereby allow the application for extension of stay order dated 03.04.2025 filed by the respondent no. 6 to 8 without considering the poor health condition of the petitioner who is aged about 67 years old and suffering from heart problem, infection in kidney, high sugar and he need urgent treatment, but the learned Commissioner allow the application filed by the petitioner in 11 years time barred appeal due to the impugned order the petitioner is not able to disburse the award amount granted in favour by the respondent no. 4 under the Land Acquisition Act. 3. On the other hand, counsel for the State opposes the contention made by the counsel for the petitioner. 4. I have heard learned counsel for the parties at length and perused the record with utmost circumspection. 5. Considering the facts and circumstances of the case and the submissions made by the counsels, respondent no. 2 is directed to decide the appeal filed by the petitioner expeditiously as soon as possible in accordance with law, rules and regulations. 6. With the aforesaid direction, the present petition is disposed of. Sd/-
