2.
Learned counsel for appellant submits that appellants are innocent persons and they were falsely implicated by police under the pressure of complainant party. He also submits that initially a charge-sheet was filed against four persons and all four were convicted by the Trial Court. He also submits that these accused were on bail during trial. He further submits that as per post mortem report Ex. P-40 and evidence of PW-28, there was one injury on head of deceased Shambu Dayal and attribution was made upon Shivram. He further submits that only to exaggerate the facts these appellants were unnecessarily named. He further submits that the injury upon deceased was caused by blunt object and that too without intention to commit murder or culpable homicide. He further submits that these appellants were on bail during trial and disposal of appeal will take its own time. At last, he submits that this Hon’ble Court has already allowed application for suspension of sentence of four accused on 28.04.2025 and the case of these appellants-accused is identical with those four accused so they too be released on bail. 3. Aforesaid contentions were opposed by learned Public Prosecutor and learned counsel for complainant. Learned Public Prosecutor has submitted custody certificate and same is taken on record. 4. Heard learned counsels for both the parties along with learned Public Prosecutor. Perused the entire material available on record. 5. On basis of report Ex. P.2 dated 17.03.2009 about assault by Suresh and others FIR No. 40/09 under Sections 143, 323 and 341 IPC was registered at Police Station, Raini, District Alwar. [2025:RJ-JP:20536] (3 of 5) [SOSA-928/2025] After investigation, police has filed a charge-sheet against Santosh, Nemi Chand, Shivram and Dayaram but kept pending against other persons under Section173(8) of Cr.P.C. At this stage, it is not possible for us to express any opinion on the merits of the case, but the disposal of appeal will take its own time and looking to the overall facts and circumstances of the case without expressing any opinion on the merits of the case, it is appropriate to allow application for suspension of sentence.
