1. Prayer made in the present petition for quashing the order dated 03.01.2006, whereby the claim of the petitioner for appointment on the compassionate ground was rejected.
2. Learned State counsel refers to preliminary submission No.1 of the written statement dated 14.12.2006, to which there was no replication and read thus:
“ …. That the appointments on compassionate grounds are governed under the instructions dated 21-11-2002 (Annexure P-7). The claim of the petitioner for compassionate appointment after going missing of his father is not covered under these instructions. Undoubtedly a provision for compassionate appointment to a family member of a missing Govt. Servant has been made through Para No. 12 of these instructions but sub para b(i) of instructions lays a specific condition that the benefit of compassionate appointment will not be available in case of a Govt. employee who had less than 7 years to retire from the date of missing till his superannuation. In the instant case father of petitioner had only 6 years 6 months 17 days from 13-12-1990, the date of his father going missing till attaining the age of superannuation on 30.06.1997, therefore, the orders rejecting the claim of the MOHIT 2025.05.02 15:30 I attest to the accuracy and integrity of this document
CWP-10474-2006 (O&M) -2- petitioner for appointment on compassionate grounds are valid and legal. Therefore, the present writ petition being devoid of merits is liable to be dismissed.”

Learned counsel for the petitioner also states that despite best efforts he has not been able to establish contact with the client.

Disposed of, reserving the petitioner with a liberty to get it revived, in case lis still survives.
