In view of the submissions made by learned counsel for the applicant-appellant and for the reasons mentioned in the application, the application (CMCC No. 2071/2025) for condonation of delay is allowed and the delay of 897 days which occurred in filing the restoration application, is condoned. The restoration application has been filed by the applicant- appellant for restoration of Civil Misc. Appeal No.224/2020 to its original number, which was dismissed for non-prosecution vide order dated 30.1.2023. Considered the submissions. Having regard to the submissions made by counsel for the applicant-appellant and for the reasons mentioned in the (2 of 2) [CRES-438/2025] restoration application, this Court deems just and proper to allow the restoration application and restore the appeal to its original number. Accordingly, the present restoration application is allowed subject to payment of cost of Rs.1,000/- to be deposited with the Rajasthan High Court Munshi Sangh, Jaipur Bench, Jaipur. On submission the receipt of deposited amount by the counsel for the applicant/appellant with the Registry, the Civil Misc. Appeal No.224/2020 be restored to its original number.
