Dhaval Jain, Municipal Commissioner, Kolkata Municipal Corporation in WPA 11677 of 2017 Mr. Raghunath Chakraborty …for the petitioners Mr. Aloke Kumar Ghosh Mr. Arijit Dey …for the alleged contemnor This application has been filed alleging deliberate and willful violation of the judgment and order dated September 8, 2022 passed in WPA 11677 of 2017. The alleged contemnor has filed the affidavit of compliance on July 25, 2025. On that date on the prayer of the learned advocate appearing for the petitioner, the hearing of the contempt application was adjourned. Today, when this matter is taken up, Mr. Chakraborty, learned advocate for the petitioners, submits that the petitioners have been duly paid the amounts which they are entitled to in terms of this order. He, however, draws the attention of the court to an observation made in paragraph 15 of the said order and submits that the alleged contemnor be directed to extend the benefits of this order to other Sub-Assistant Engineers of the Kolkata Municipal Corporation who are similarly placed as that of the petitioners. Mr. Ghosh, learned advocate for the alleged contemnors submits that the order and directions passed in the said order has been duly complied with and the scope of the contempt application cannot be enlarged. Since the petitioner have already received payment, the order and directions have been complied with. Nothing remains to be decided in the contempt application. Accordingly, CPAN 111 of 2025 stands disposed of. The Rule stands discharged. (Hiranmay Bhattacharyya, J.) 2
