BY ITS COMMISSIONER, VISAKHAPATNAM. ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased toto issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, to declare the inaction on the part of the Respondents in not allotting the houses to the Petitioners under JNNURM Scheme in terms of G.O.Rt.No.314 dated 20-12-2006, despite completion of Page 5 of 8 SRS,J W.P.No.27222 of 2013 verification process as arbitrary, illegal and discriminatory and consequently direct the Respondents to allot houses to the Petitioners in preference to fresh applicants and pass IA NO: 1 OF 2013(WPMP 33704 OF 2013 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the Respondents to consider the cases of the Petitioners for allotting the houses to the Petitioner under JNNURM Scheme in terms of G.O.Rt.No.314 dated 20-12-2006, in preference to fresh applications keeping in view, the abject poverty of the Petitioners and pass IA NO: 4 OF 2013(WPMP 165748 OF 2013 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased IA NO: 1 OF 2014(WPMP 49172 OF 2014 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to permit the petitioner to substitute the following "It is therefore prayed that this Hontle Court may be pleased to issue any Writ, order, or Direction particularly a Writ in the nature of MANDAMUS declaring the endorsement dated 28-01- 2014 of the 277 Respondent in not considering allotment of the houses to the Petitioners under JNNURM Scheme in terms of G.O.Rt.No.314 dated 20-12- 2006, despite completion of verification process as arbitrary, illegal and discriminatory and consequently direct the Respondents to allot houses to the Petitioners in preference to fresh applicants and pass such other relief or reliefs as this Hon'ble Court may deem fit just and proper in the circumstances of the case." M RAVINDRANATH REDDY(SC FOR APSHC) The Court made the following: :: ORDER :: Heard Sri N. Appa Rao, learned counsel representing Dr.P.B. Vijaya Kumar, learned counsel for the petitioners. 2. The above writ petition is filed to declare the inaction of the respondents in allotting the houses to the petitioners under the JNNURM Scheme in terms of G.O.Rt.No.314 dated 20.12.2006, despite completion of the verification process, as illegal and arbitrary. 3. The grievance of the petitioners is that the Central Government sanctioned urban housing for all persons below the poverty line (BPL). The beneficiary must contribute not more than 10%. Respondent No.2, Municipal Corporation, constructed 15320 houses in and around Visakhapatnam, and several beneficiaries have been identified by engaging agencies. However, when it comes to allotment, the list is being changed from time to time, and illegal allotments were made during the regime of Vishnu, I.A.S. The petitioners made applications. However, their names were not included in the list. Hence, the above writ petition is filed seeking a direction to respondent No.2 to consider the petitioners‟ case for allotment of house sites. 4. The writ petition was admitted on 19.09.2013 and an interim order was granted in W.P.M.P.No.33704 of 2013, which reads as under: “There shall be a direction to the respondents to allot houses strictly in accordance with the seniority in terms of identification and G.O.Rt.No.314 dated 20.12.2006.” SRS,J W.P.No.27222 of 2013 5. Thereafter, the matter was listed on 02.07.2025 and 04.07.2025, and since there was no representation for the petitioners, the matter was directed to be listed today, under the caption „for dismissal‟. 6. Today, when the matter is taken up, learned counsel for the petitioners submitted that he could not receive instructions from the petitioners after the interim order. 7. Thus, as seen from the prayer, the grievance of the petitioners is that house sites are not allotted to them under the JNNURM Scheme in terms of G.O.Rt.No.314 dated 20.12.2006. 8. In fact, by way of interim order, the relief of the petitioners has been granted on 19.09.2013, itself. Hence, no further adjudication is required in this writ petition. 9. Hence, this writ petition is closed. No costs.
