JUSTICE J.M.KHAZI ORAL ORDER The petitioner/Accused Nos.1 to 4 as well as respondent No.2/complainant and their respective learned counsel are present. 2. These petitions are filed by accused Nos.1 to 4 under Section 482 of Cr.P.C, to quash the criminal proceedings in C.C.No.1196/2022, for the offences punishable under Sections 143, 324, 504, 506 r/w Section 149 of I.P.C. 3. Separate compromise petitions under Section 528 of BNSS r/w Section 359 of the BNSS (I.A.No.1/2025), duly signed by both petitioners and respondents and their respective counsel are filed. It is - 5 - HC-KAR NC: 2025:KHC:33128 CRL.P No. 8293 of 2022 C/W CRL.P No. 7548 of 2022 supported by joint affidavit of the petitioners/accused Nos.1 to 4 and respondent No.2/complainant. 4. The terms and conditions of settlement arrived at between the parties in CRL.P No.8293/2022 reads as under: "1. The petitioners state that the instant application may be treated as part and parcel of the main petition to avoid repetition of facts. 2. The petitioners have preferred the instant Criminal Petition challenging the proceedings in C.C No.1196/2022 pending on the file of the Learned VIII Addl. Chief Judicial Magistrate, at Bengaluru for the offences punishable under Sections 143, 324, 504 and 506 read with Section 149 of the Indian Penal Code. 3. The petitioners state that the Petitioners and the Respondent No.2 due to intervention of elders, friends and well-wishers have settled the matter amongst themselves amicably and the Respondent No.2 no longer wishes to prosecute the impugned proceedings against the Petitioners. 4. The Petitioner No.1 states that he has agreed to settle the criminal proceedings initiated by him in Spl. C. No. 1437/2024 pending on the file of the - 6 - HC-KAR NC: 2025:KHC:33128 CRL.P No. 8293 of 2022 C/W CRL.P No. 7548 of 2022 Learned LXX Addl. City Civil and Sessions Judge, at Bengaluru (CCH-71) for the offences punishable under Sections 504 and 506 of the Indian Penal Code and for the offences punishable under Sections 3(1)(r)(s) of the SC/ST Act wherein, the Respondent No.2 herein is arrayed as the sole Accused. 5. The petitioners further state that it has been agreed that the Respondent No.2 would not prosecute the instant criminal case and hence the Respondent No.2 has no objections for quashing, closing, compounding of the entire proceedings in C.C No.1196/2022 pending on the file of the Learned VII Addl. Chief Judicial Magistrate, at Bengaluru for the offences punishable under Sections 143, 324, 504 and 506 read with Section 149 of the Indian Penal Code. WHEREFORE, the Petitioners and the Respondent No.2 humbly pray that this Hon'ble Court be pleased allow the instant application and permit the Petitioners and Respondent No.2 to compound the offences as alleged against the Petitioners and further to quash the entire proceedings in C.C No.1196/2022 pending on the file of the Learned VII Addl. It is submitted that parties to this petition have compromised, having regard to the fact that benefit of this order is also to be given to accused No.5, who is not a party before this Court. 7. Respondent No.2/complainant admits the compromise and submits that he has no objection to allow the petitions. The terms and conditions of compromise - 9 - HC-KAR NC: 2025:KHC:33128 CRL.P No. 8293 of 2022 C/W CRL.P No. 7548 of 2022 petition are legal and equitable. The same is accepted and accordingly, following: ORDER (i) Crl.P No.8293/2022 filed by the petitioner/accused No.1 and 2 and Crl.P No.7548/2022 filed by the petitioners/accused Nos.3 and 4 under Section 482 of Cr.P.C, are allowed. (ii) The entire proceedings in C.C.No.1196/2022 on the file of VIII Additional Chief Metropolitan Magistrate, Bengaluru, is hereby quashed, giving benefit of this order also to accused No.5.
