Affidavit-of-service filed by the petitioners be kept with the record. Petitioner has approached this Court in respect of certain festivals which the private respondents intend to organize or celebrate within the complex premises of Purti Flowers Owner’s Association. Petitioners claim that they submitted a representation to the Inspector-in-Charge of Maheshtala Police Station as well as the Superintendent of Police, Diamond Harbour Police District regarding the respondents announcing celebration of a festival on 05.09.2025 at 07.00 PM. Petitioners have their objections as is reflected from their representation made to the police authorities. Learned advocate for the private respondents are present and submits that they have informed through mail and they were not responded to by the apartment
2 owners. Necessary informations have been sent to the police authorities also. Since the nature of the dispute is absolutely a private dispute, police authorities will not interfere themselves except for the purposes of upkeep of law and public order. So far as the rights of the parties are concerned they would approach the other forum for establishing their rights, in summary manner such rights cannot be decided in the writ petition. With the aforesaid observations WPA 20632 of 2025 disposed of. Report so submitted by the State be kept with the record. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
