Heard learned counsel for the parties and perused the record. 2. The instant writ petition has been filed for following relief: "A. Issue a writ, order or direction in the nature of writ of mandamus directing the respondent No.2/ Tehsildar, Aurai, District- Sant Tehsil- Ravidas Nagar (Bhadohi) to decide the Execution Case No. NILL of 2024 (Report Lekhpal Vs. Shanti Devi) under section 67 of U.P. Revenue Code, 2006, expeditiously within stipulated period Hon'ble Court." 3. Contention of the learned counsel for the petitioner is that despite an order passed under Section 67 of the U.P. Revenue Code, 2006, the encroachments have not been removed. In this regard, the petitioner has moved an application before the Tehsildar, which is at Page 29 of the writ petition. 4. From perusal of the application, it is apparent that the execution application has been moved by the Gaon Sabha under Section 460 of the U.P. Revenue Court Manual, which is pending and petitioner is not party to the proceedings, therefore he has no right to move an application for execution. 5.
