1. This is the second bail application filed by the applicant. The first bail application of the applicant has been dismissed as withdrawn after arguing for some time on 21.11.2024 passed in MCRC No.6813 of 2024, and liberty was also granted to the applicant to repeat his prayer for bail after examination of material witnesses.

Learned counsel for the applicant would submits that the victim and her mother has been examined before the Trial Court and the school teacher with respect to the school record has also been examined before the learned trial Court, and since there has been no considerable progress in the trial of the case, he has filed the second bail application. On the other hand, learned counsel for the state opposes and have submitted that when the first bail application of the applicant was dismissed on 21.11.2024, the witnesses have already been examined on 30.08.2024 & 12.09.2024 and there is no change in circumstance after 21.11.2024, therefore, the applicant is not entitled for bail.
4. Considering the submissions made by learned counsel for the parties and considering the fact that the witnesses PW-1 has been examined on 29.07.2024, PW-2 has been examined on 30.08.2024, PW-3 & PW-4 have been examined on 12.09.2024, that is prior to the date of passing of the
order dated 21.11.2024 and there is no material produced by the applicant after 21.11.2024, with respect to the change in circumstance of the case.
5. Therefore, I do not find any good ground to admit the second bail application filed by the applicant, therefore, it is dismissed at motion stage itself. Sd/- (Ravindra Kumar Agrawal) Judge
