1. Heard Mr.Sumit Singh, learned counsel for the petitioner as well as Mr.Hariom Rai, learned Panel Lawyer appearing for the respondent/State. 2. The present petition has been filed by the petitioner under Section 528 of the Bhartiya Nagrik Suraksha Sanhita, 2023 with the BABLU RAJENDRA BHANARKAR Digitally signed by BABLU RAJENDRA BHANARKAR Date: 2025.08.07 18:22:08 +0530
2 following prayers :-
“It is therefore, prayed that this Hon'ble Court may graciously be pleased to allow the Petition and quash the FIR No. 193/2024 dated 05.08.2024 registered at Police Station Jashpur Dist.- Jashpur (C.G.) under Section 420, 120-B of IPC and charge sheet No. 164/2024 filed in the court of Chief Judicial Magistrate, Jashpur (C.G.) bearing criminal case no. 965/2024. The Hon'ble court may also be pleased to quash the order dated 07.10.2024 wherein the Ld. Chief Judicial Magistrate, Jashpur (C.G.) has taken cognizance of the matter and further also be pleased to quash the order dated 06.01.2025, whereby the Ld. CJM Jashpur has framed the charges against the petitioner for the offence under section 420, 120-B of Indian Penal Code in the interest of justice.”

From perusal of the pleadings, it transpires that the complainant who was informant in the present case has not been impleaded as one of the party respondent, which goes to show that the petition drafted by learned counsel for the petitioner is in a very casual manner and further wasted the precious time of the Court, as such, in the opinion of this Court, the petition is liable to be dismissed on the ground of non-joinder of necessary party. 4. Accordingly, the instant petition is dismissed on the ground of non-joinder of necessary party with liberty to file afresh petition with necessary party. 5.
This Court intended to impose Rs.2000/- as cost to the petitioner,
3 but earlier also, this Court while dismissing the petition being CRMP No.1794 of 2025 vide order dated 12.06.2025 has imposed cost of Rs.3000/- to the petitioner, which the petitioner has already paid, the Court drop the same. 6. Certified copy of the documents annexed with this petition shall be returned to the counsel for the petitioner after retaining the photocopies of the same.
