Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue Writ, Order or direction, more particular in nature of Writ of^ Mandamus, declaring the action of the respondents in not considering petitioners claim for absorpetion into department however they are continusly working since 25 years and even not paying minimum time scale attached to the post held by them while regularizing the services of the similarly placed persons and paying the minimum time scale attached the posts to the individuals who are working in other wings of the T.T.D., is illegal, arbitrary and violation of Article. 14 of the Constitution of India and contrary to the dicta laid down by the Hon'ble Appex Court in Uma Devis case and consequently direct the respondents to regularize the services of the petitioners as Mazdoors in TTD Forest Wing with all consequential benefits on the ground they are working nearly 25 years in the interest of justice. lA NO:

When these matters are taken up for hearing, Sri Srinivasa Rao Madiraju, Sri B.Umamaheswara Rao and Sri B.Eswaraiah Chowdary, learned counsel for the Petitioners would submit that so far as the relief relating to minimum time scale is concerned, interim order passed by this Court been complied with. 3. Ms.V.Dyumani, learned Standing Counsel for T.T.D Court may pass appropriate orders. 4. Considering the submissions made and on a fair look at the material placed on record, this Court is of the view that, in the light of Section 97 of the A.P.Charitable and Hindu Religious Institutions regarding the policy matters. Board of Trustees has would submit that and Endowments Act every authority to take a decision and the same has not been done in the present case. For ready references, Section 97 of the said Act is extracted hereunder: ' functions of the Board- The Board shall in addition to the powers conferred and functions entrusted to it by IS Act, exercise such other powers and perform such other functions as may be prescribed in regard to matters of policy and general superintendence and review in relation to the Administration of Tirumala Tirupathi Devasthanams having due regard to public interest and the services and amenities to be provided to and welfare safety measures to be undertaken for the Pilgnrns, devotees and worshippers resorting to Tirumala Tirupathi Devasthanams.”
5. In that view, it is apposite to dispose of these Writ Petitions, without touching the merits of the same with the following directions. Petitioners shall submit (i) a comprehensive representation covering their pleadings supported by the relevant documents and the judicial precedents, if any, to the Executive Officer of Tirumala Tirupati Devasthanams within a period of two weeks from the date of receipt of copy of this Order. The Executive Officer, in turn, shall place the same before the Board of Trustees as expeditiously as possible. (ii)
5 (Hi) The Board of Trustees shall take to governing Rules and law within receipt of representation of the Petitioners. a decision over the matter according a period of three months from the date of (IV) Depending on the decision to be taken, the Board shall forward proposal to the Government forthwith for getting necessary approval.
(V) Respondent No.3 / Government is directed to consider the said proposal and take appropriate decision according to governing Rules and Law. within a period of three months therefrom.
