The petitioner is apprehending his arrest in connection with Complaint Case no. 1256 of 2024, pending in the court of the learned Additional Chief Judicial Magistrate, Bermo at Tenughat, registered for the offence under sections 84, 115(2), 126(2), 303(2), 64, 62 of BNS, 2023 and sections 3, 4 and 5 of Muslim Woman (Protection of Right on marriage) Act, 2019. Later on, cognizance has been taken for the offence under Section 85 of BNS, 2023 3. Learned counsel appearing for the petitioner submits that petitioner happened to be husband of the complainant and the false complaint case has been filed and there are general and omnibus allegation. He also submits that the learned Court has been pleased to take cognizance only against this petitioner. 4. Learned counsel appearing for the State opposed the prayer and submits that the petitioner happened to be husband and in view of that anticipatory bail may kindly be rejected. 5. Considering that the petitioner is husband and there are general and omnibus allegation and even the molestation allegation is made 2025:JHHC:36714 2 against the brother of the petitioner and the learned Court has taken cognizance against this petitioner only. 6. In view thereof, the petitioner above named is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and condition or sureties, the learned Court may deem fit and proper. 7.
