Appellant Represented by Adv. - Dillip Kumar Mohapatra -versus- State Of Odisha & Ors. ..... Respondent Represented by Adv. – Sasmita Nayak, A.S.C. CORAM: THE HON’BLE MR. JUSTICE ADITYA KUMAR MOHAPATRA ORDER 02.02.2026 Order No. 01. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode). 2. Heard learned counsel for the Appellant as well as learned Additional Standing Counsel for the State-Respondents. 3. The present appeal has been filed at the instance of the appellant thereby challenging judgment dated 30.08.2025 passed in GIA case No.254 of 2025 by the learned State Education Tribunal. 4. Learned counsel for the appellant at the outset contended that the present appeal is squarely covered by the common judgment dated 23.06.2025 passed by the learned Coordinate Bench in FAO No.281 of 2018. Learned counsel for the State on the other hand contended that she has no specific instruction with regard to the present appeal preferred by the appellant. 6. Considering the submissions made by learned counsel for the appellant that the issue has already been decided by the coordinate bench in its judgment dated 23.06.2025 in FAO No.281 of 2018, this Court disposes of the present appeal in terms of the judgment dated 23.06.2025. However, while disposing of the present FAO, liberty is granted to the State to file an application for recalling of this order, in the event it is found that the submissions made by learned counsel for the Petitioner the present appeal is not covered by the judgment in FAO No.281 of 2018 is incorrect. 7.
