Dhanushya, learned counsel appearing on behalf of Smt. Namitha Mahesh B.G., counsel for the petitioner and Sri Khaleel Ahammed, learned counsel appearing on behalf of Sri Bimbadhara H.M., counsel for the respondent. 2. Civil petition is filed with the following prayer: “Wherefore, it is prayed that this Hon’ble Court may be pleased to transfer the above M.C.No.70/2024 pending on the file of Addl. Snr.Civil Judge and J.M.F.C Court, Sagar to the family court in Davangere in the interest of justice and equity.” 3. Respondent is the husband of the petitioner and respondent having filed an application under Section 9 of the Hindu Marriage Act seeking restitution of conjugal rights, which is pending on the file of Senior Civil Judge, Sagara. Said case is now sought to be transferred to Family Court at Davanagere. 4. Petitioner has expressed financial difficulty and also apprehends that she cannot visit the Sagara for effectively participating in the case without the proper assistance. - 3 - HC-KAR NC: 2025:KHC:43020 CP No. 285 of 2024 5. Such an apprehension of the petitioner can be quelled by directing the petitioner to participate in the proceedings through Video Conferencing. 6. If any such application is filed by the petitioner before the Court at Sagara, learned trial Judge shall permit the petitioner to participate through Video Conferencing. 7.
