This writ petition is filed under Articles 226 & 227 of the Constitution of India, challenging the order dated 14.01.2023 (Annexure-U) passed by the appellate authority and also the order dated 23.10.2017 passed by the disciplinary authority vide Annexure-N.
2. The case of the petitioner is that the petitioner was working as Assistant Registrar, Estate Division of the respondent – University. At that time, a departmental enquiry has been initiated. After conducting the enquiry, the disciplinary authority by order dated 23.10.2017, imposed the penalty as follows:

3. In the appeal filed by the petitioner, the order passed by the disciplinary authority has been confirmed. Being aggrieved, the petitioner has filed this writ petition.

4. The learned counsel appearing for the petitioner submits that the petitioner will not press the relief sought in this writ petition. He contended that, now the petitioner is entitled for promotion and the impugned order will not come in the way of granting promotion to the petitioner. Even though the petitioner is entitled to be promoted to the post of Deputy Registrar, his case has not been considered. Therefore, he contended that the respondent may be directed to consider the case of the petitioner for promotion.
5. The learned counsel appearing for the respondent – University submits that, if the impugned order dated 23.10.2017 will not come in the way of promoting the petitioner, if the petitioner submits such a representation, the University will consider his case for promotion, in accordance with law.
6. In view of the above, this writ petition stands
disposed of, reserving liberty to the petitioner to submit a

representation for consideration of his case for promotion. If such a representation is submitted, the respondent is
directed to consider the same in accordance with law.
