On the basis of a complaint lodged by one T.N. Umesha a case in Crime No.378/2025 has been registered at Sira Police Station against accused Nos.1 to 4, for the offence punishable under Section 121(1), 132, 352 r/w 3(5) of BNS, 2023. 3. The first informant is working at Inspection Bunglow (IB), Sira, Tumakuru. It is alleged in the - 3 - HC-KAR NC: 2025:KHC:34903 CRL.P No. 12039 of 2025 complaint that on 31.07.2025 at about 8.30 p.m., while he was in the IB, accused arrived in an inebriated condition and asked him to provide them a room and when he told them that only the Government employees and VIPs are entitled to the facility, the said accused abused him and assaulted with hands and obstructed him from discharging his duties. 4. The incident is alleged to have taken place on 31.07.2025 at about 8.30 p.m. Complaint is lodged on 01.08.2025 at 11.00 a.m. It is seen that FIR was received by the learned Magistrate on the next day i.e., 02.08.2025 at 10.30 a.m. 5. It is contended by the learned counsel that petitioners are innocent and no such incident as alleged has taken place and a false case was registered against them. He contended, the complainant has not sustained any injuries and allegations that the accused were in an inebriated condition and picked up quarrel and abused and assaulted the complainant etc., is a matter which has to - 4 - HC-KAR NC: 2025:KHC:34903 CRL.P No. 12039 of 2025 be established in due course. Petitioners have undertaken to cooperate with investigation of the case. It is submitted that there are no criminal antecedents against the petitioners. Usual apprehension of the prosecution can be taken care of by imposing necessary conditions. Hence, the following: ORDER i. Petition is allowed. ii. Petitioners/accused Nos.1 to 4 shall be released, in the event of their arrest in Crime No.378/2025 of Sira Police Station, Tumakuru, subject to following conditions: a) They shall appear before the Investigating Officer within one week from the date of receipt of a copy of this order and shall execute a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) each, with one surety for the likesum and shall cooperate with the investigation. - 5 - HC-KAR NC: 2025:KHC:34903 CRL.P No. 12039 of 2025 b) They shall furnish their residential address/contact number and shall inform the I.O in case of any change in the address/contact number. c) They shall not tamper with the prosecution evidence/witnesses either directly or indirectly. d) They shall be regular in attending the Court proceedings.
