Heard learned counsel for the revisionist, learned A.G.A. for the State, learned counsel for the opposite party nos. 2 to 6 and perused the material on record. 2. Learned counsel for the revisionist has submitted that respective accused persons belong to the OBC/General Category and they do not belong to the SC/ST Category. Learned counsel for the revisionist has further submitted that on this ground alone order dated 25.01.2024 has been passed wherein compliant/application under Section 156(3) Cr.P.C. has been rejected. 3. On the other hand, learned counsel for the opposite party nos. 2 to 6 did not dispute the fact that the opposite party nos. 2 to 6 belong to the OBC or General Category but not to SC/ST Category. 4. Without going into any other controversy, the order dated 25.01.2024 is set aside and the concerned Special Judge, (SC/ST Act) is directed to reconsider the same and pass the order afresh. 5. With the aforesaid observation and direction, the present revision is disposed of.
