Order 19/12/2025
1. These criminal misc. bail applications have been filed by the petitioners under Section 483 of BNSS, 2023 in respect of FIR No.226/2025 registered at Police Station Rudawal, District Bharatpur for the offences punishable under Sections 318(4), 338 of BNS.
[2025:RJ-JP:51419] (2 of 3) [CRLMB-15968/2025]
2.
Learned counsel for the petitioners submits that the offences alleged in the FIR are otherwise triable by Magistrate. They have falsely been implicated in the FIR and have not committed any offence whatsoever. It is submitted that the allegation is of submitting application for claiming benefit of pension under the Chief Minister Ayushman Durghatna Bima Yojana and admittedly, no such benefit was ever extended as the application filed by the petitioners has been dismissed. Petitioners are behind the bars since 22.11.2025 and 21.11.2025 respectively and trial is likely to take considerably long time. Hence, the petitioners prayed for granting bail in the instant matters.
3. Learned Public Prosecutor has vehemently opposed these bail applications.
4. Considered the submissions made at Bar.
5. In view of the fact that the application filed by the petitioners for getting benefits under the aforesaid pension scheme was dismissed and no benefits whatsoever were actually extended to the petitioners moreover looking to the fact that offences alleged against the petitioners are triable by Magistrate, hence, without expressing any opinion on the merits and demerits of the case, this Court deems it just and proper to enlarge the petitioners on bail.
6. Accordingly, these Bail Applications are hereby allowed. The accused-petitioners (1) Akash S/o Harbhan Singh and (2) Kunwar Singh S/o Shri Vijendra Singh shall be released on bail in pursuance of FIR No.226/2025 registered at Police Station
[2025:RJ-JP:51419] (3 of 3) [CRLMB-15968/2025] Rudawal, District Bharatpur, on each of them furnishing a personal bond of Rs. 1,00,000/- along with two sureties of Rs.50,000/- each. That apart, the accused-petitioners shall also follow the conditions as under:- (i) They shall not tamper with any evidence, nor would influence the witnesses in the case. (ii) They shall not leave the country without prior permission of the Court. (iii) They shall co-operate in the trial and shall attend each and every date of hearing in the trial, until and unless their presence is exempted by the trial Court.
