JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER The petition is filed by accused No.4 under Section under Section 439 of Cr.PC praying to grant bail in Crime No.310 of 2019 registered for the offences punishable under Sections 399, 402 of IPC and Section 25 of Arms Act, 1959 pending in CC No.50098 of 2020 on the file of the learned 43rd Additional Chief Metropolitan Magistrate, Mayohall, Bangalore City. 2. Heard the learned counsel for petitioner and learned Additional State Public Prosecutor for respondent - State. 3. The petitioner earlier was granted bail by order dated 10.01.2020 in Crl.Misc. No.25025/2020, and he was released on bail on 04.02.2020. Thereafter he had attended the Court till 10.06.2022. He remained absent from 22.07.2022, and to secure his presence, NBW has been issued from time to time. Subsequently, NBW issued - 3 - HC-KAR NC: 2025:KHC:42245 CRL.P No. 12873 of 2025 against the petitioner has been executed, and he has been secured on 29.07.2025, and he is in judicial custody. The petitioner remained absent for three years. The learned counsel for petitioner submits that, petitioner was under impression that, case has been committed, and after receipt of summons from the Sessions Court, he has to appear before the Sessions Court. The petitioner is in judicial custody since 29.07.2025. He has undertaken to appear before the Committal Court and Sessions Court. 4. Upon perusal of order sheet of CC No.50098 of 2020, there is NBW pending against accused Nos.1, 3 and 5. Considering the said aspect, the petitioner has made out a case for grant of bail with conditions. In the result, the following: ORDER i) The petition is allowed. ii) The petitioner is granted bail in Crime No.310 of 2019 of HAL, PS pending in CC No.50098 of 2020 on the file of the learned 43rd Additional Chief Metropolitan - 4 - HC-KAR NC: 2025:KHC:42245 CRL.P No. 12873 of 2025 Magistrate, Mayohall, Bangalore City, subject to following conditions. a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the jurisdictional Court; b) He shall not tamper the prosecution witnesses either directly or indirectly; c) He shall attend the Committal Court and Sessions Court on all dates of hearing, unless exempted, and cooperate for speedy disposal of the case. d) He shall furnish his Aadhar card or any other authentic document for address proof. e) He shall attend the jurisdictional police station on the first Sunday of every month till the case against him is disposed of.
