Heard learned counsel for the petitioner and Ms. Manjari Singh, learned counsel for the respondent nos.1 & 3. 2. The petitioner by means of the present writ petition has prayed for the following relief:- "i. Issue a writ, order or direction in the nature of mandamus to declare property as evacuee after due investigate. ii. Issue any suitable writ, order or direction which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case. iii. To award the cost of the present writ petition to the petitioner." 3. The petitioner is complainant and he is not aggrieved by the declaration of property as evacuee as none of the rights of the petitioner is prejudiced. 4. In such view of the fact, the petitioner has no locus standi to file the present writ petition. 5. Consequently, the writ petition is dismissed with no order as to costs.
