The Second Appeal is preferred by the appellant against the Judgment and Decree dated 12.11.2001, passed in A.S.No.172 of 2000 (A.S.No.49 of 1995 of K.S.C.), on the file of the learned Senior Civil Judge, Tadepalligudem, West Godavari District.
2. None appeared for the appellant. Learned counsel for the respondent is present.
3. On 02.01.2025, since it was brought to the notice of this Court learned counsel for the appellant had passed away, this Court ordered notice to the appellant.
4. As per the endorsement made by the Registry, notices were returned un-served though the notice sent to the address shown in the appeal. Despite the best efforts of this Court, the notice could not be served on the appellant and without proper representation from both sides, this Court is unable to adjudicate the matter further and deems fit to dismiss the appeal.
5. Accordingly, the Second Appeal is dismissed for default. There shall be no order as to costs.
Interim orders granted earlier, if any, shall stand vacated.
Miscellaneous petitions pending, if any, in this appeal shall stand closed.
