JUSTICE MOHAMMAD NAWAZ ORAL ORDER Petitioner is accused of committing offence punishable under Section 12 of the POCSO Act, 2012 and Section 77 of BNS, 2023. 2. Complaint is lodged by one Pulluri Hari Krishna, based on which, a case in Crime No.342/2025 has been - 3 - HC-KAR NC: 2025:KHC:36237 CRL.P No. 11303 of 2025 registered against the petitioner at Kadugodi Police Station, Bangalore for the aforementioned offences. 3. It is alleged that petitioner, a neighbor, has recorded a video of complainant's wife, aged 29 years and daughter, aged 9 years, while they were taking bath on 08.07.2025 between 06.20 a.m. to 06.50 a.m. 4. Petitioner was arrested on 09.07.2025. A mobile phone has been recovered from him. It is contended by the learned counsel for the petitioner that no incriminating material has been retrieved from the mobile phone of the petitioner. 5. Investigation is completed and charge sheet has been filed. The offences alleged are punishable with a maximum imprisonment of three years. Petitioner has no criminal antecedents. The prosecution has to establish its case against the petitioner in a full-fledged trial. The apprehension of the prosecution can be taken care of by imposing necessary conditions. Petitioner is not required for further interrogation, as the charge sheet is already filed. Petitioner/accused in Crime No.342/2025 of Kadugodi Police Station, Bangalore is directed to be released on bail subject to the following conditions: 1. He shall execute a personal bond in sum of Rs.50,000 (Rupees Fifty Thousand only) with two sureties for the likesum to the satisfaction of the jurisdictional court. 2. He shall furnish his residential address and inform the Investigation Officer if there is change with his address. 3. He shall not indulge in committing any offence. 4. He shall not tamper with the prosecution witnesses either directly or indirectly. 5. He shall appear before the Trial Court on every date of hearing the other bail.
