Dharm Singh @ Tarun Son Of Shri Kuldeep Singh, Aged About 19 Years, R/o House No. 255-256 Ajwa Road, Dutt Nagar, Chebapod, Vadodara, Gujarat ( At Present Confined In District Jail Jaipur) ----Applicants Versus State Of Rajasthan, Through P.p. ----Respondent For Applicant(s) : Ms.Nidhi Sharma For Respondent(s) : Mr.Vijay Singh Yadav HON'BLE MR. JUSTICE RAVI CHIRANIA Order 19/12/2025 1. The instant bail application has been filed by the applicants Daljit Singh @ Taki Singh Son Of Shri Gurmeet Singh and Dharm Singh @ Tarun Son Of Shri Kuldeep Singh, aged about 30 and 19 Years respectfully, arrested by the police on 25.11.2025 in connection with the FIR bearing No.444/2025 dated 08.11.2025 registered against them at Police Station Bajaj Nagar, Jaipur City (East) for the offences punishable under Section 305(a) of B.N.S, in which they have not been named. The bail application of the applicant was rejected by the Learned Upper Session Judge No.2, Jaipur Metropolitan First vide order dated 01.12.2025, thereafter, [2025:RJ-JP:51691] (2 of 3) [CRLMB-16424/2025] the applicants have preferred this bail application under Section 483 B.N.S.S. 2. Learned counsel submits that the accused-applicants have been arrested on 25.11.2025 and the police after interrogation has not made any recovery from the applicants, as the allegations levelled against them are false. Learned counsel submits that the allegations are against other persons and the accused-applicants have not even been named in the FIR. In view of the above facts, learned counsel submits that the accused-applicants have falsely been implicated in the present case, and they may be enlarged on bail. 3. Learned Public Prosecutor strongly opposed the bail application on the ground that the relatives of the accused- applicants are involved in the offence, however, could not dispute the fact that no recovery was made from the accused-applicants till today and they have not been named in the impugned FIR 4. Considering the overall facts and circumstances of the case, and noticing the fact that the applicants have not been named in the FIR and they have no criminal antecedents, this Court is inclined to exercise its power under Section 483 B.N.S.S. and deems it just and proper to enlarge the accused-applicant on bail. 7. Accordingly, the bail application filed under Section 483 B.N.S.S. is allowed and it is directed that accused-applicant - Daljit Singh @ Taki Singh Son Of Shri Gurmeet Singh and Dharm Singh @ Tarun Son Of Shri Kuldeep Singh shall be released on bail, provided each of them executes a personal bond in a sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned trial Court for their [2025:RJ-JP:51691] (3 of 3) [CRLMB-16424/2025] appearance before that Court on each and every date of hearing and whenever called upon to do so till the completion of the trial. The applicants are further directed not to take undue advantage of liberty or misuse liberty. It is made clear that the observation as made by this Court in the bail application will not affect the trial of the case. (RAVI CHIRANIA),J Monika/221
