Petitioner has been made an accused in connection with Manatu P.S. Case No. 14 of 2024, Corresponding to Special POCSO Case No. 108 of 2024, for the offence under section 376 of the Indian Penal Code and under sections 4 & 8 of the POCSO Act, pending in the court of learned Additional Sessions Judge-IV-cum Exclusive Special Judge, (POCSO Act), Palamau at Daltonganj. On 13.04.2024, the petitioner is alleged to have raped the victim. Learned lawyer for the petitioner submitted that the victim has stated her age to be 14 years which has been falsified during the course of investigation. It was further submitted that the doctor who had examined the victim after the occurrence, did not find any sign of rape. It was further submitted that there is delay of two days in lodging of the FIR. The victim has specifically stated that the petitioner has raped her. She has also stated that he had threatened her that if she will disclose the occurrence to anyone, she will have to face dire consequences.
