Ram Singh S/o Baluram, aged about 46 years, R/o Barhet District Jhunjhunu. ----Accused/Respondents For Petitioner(s) : Mr. Hem Singh For Respondent(s) : Mr. Manvendra Singh Shekhawat, PP HON'BLE MR. JUSTICE ANAND SHARMA Order 12/11/2025 1. Petitioner has challenged order dated 18.01.2018 passed by Sessions Judge, Jhunjhunu, whereby revision petition filed by the petitioner against order dated 19.09.2017 has been dismissed. [2025:RJ-JP:45434] (2 of 3) [CRLMP-1155/2018] 2. It is submitted by the learned counsel for the petitioner that the petitioner lodged one FIR No.9/2015 registered at Police Station-Malsisar, District-Jhunjhunu against the respondents- accused for committing offences under Sections 419, 420, 467, 468, 471, 120B, 166, 177, 182 of IPC. 3. Pursuant to the aforesaid, investigation was conducted by the police authorities and finding no cognizable offences in the matter, negative final report was accepted by the Competent Court which was opposed by the petitioner by way of filing protest petition. However, protest petition was dismissed and negative final report submitted by the police authorities was accepted by the learned Court below. Feeling aggrieved, the petitioner filed revision petition before the Revisional Court. However, the Revisional Court has not exercised its jurisdiction properly. 4. Learned Public Prosecutor opposed the petition and submitted that the learned Courts below have passed the orders impugned after properly examining the record of the case and finding no ground for interference. 5. It has been admitted by learned counsel for the petitioner that civil suit with regard to sale deed, which is the subject-matter of FIR is already pending. In the light of above, no mistake was committed by the police authorities in submitting negative final report after due investigation. Perusal of negative final report would also reveal that only in order to claim share in the property, in quite malicious manner and with ulterior motive FIR was lodged by the petitioner by criminalizing the civil dispute. [2025:RJ-JP:45434] (3 of 3) [CRLMP-1155/2018] 6. In view of the above, I do not find any ground to interfere in impugned orders and the instant criminal miscellaneous petition is, hereby, dismissed.
