Deepshikha and others vs. Ashish Kumar Kohli CMP No. 19415 of 2025 in COPC No.410 of 2025 28.11.2025 Present Mr. Sunil Kumar Kaundal, Advocate, for the applicants/petitioners. Mr. Rajan Kahol and Mr. Vishal Panwar, Additional Advocate Generals and Mr. Ravi Chauhan and Mr. Anish Banshtu, Deputy Advocate General, for the respondent-State. While placing on record communication dated 11.11.2025, enclosing therewith copy of office order dated July, 2025, issued under the signatures of Deputy Director Elementary Education, Kangra at Dharamshala, learned Deputy Advocate General states that the respondents, after having considered the case of the petitioners in light of Yashwant Kumar’s case, have rejected the same because petitioners are not similarly situate to Yashwant Kumar case. Careful perusal of aforesaid documents, which are taken on record vis-à-vis mandate contained in the judgment alleged to have been violated, this Court finds that respondents have considered the case of the petitioners, but since they have not been found similarly situate to Yashwant Kumar’s case, representations filed by the applicants/petitioners have been rejected. In view of the above, no action of the respondents can be said to be contemptuous and as such, present application is disposed of. However, liberty is reserved to the applicants/petitioners to file appropriate proceedings in appropriate court of law, laying therein challenge to the order passed in purported compliance of the judgment alleged to have been violated.
